WORLD DUELS CHAMPIONSHIP
OFFICIAL COMPETITION RULES
Please read these rules before entering the World Duels Championship (the "Championship"). By entering and participating in the Championship, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements in Section 1 below.
NO PURCHASE NECESSARY.
1. Sponsor; Eligibility.
CHALLENGE ONLINE GAMES, INC. ("SPONSOR") IS THE SPONSOR OF THIS CHAMPIONSHIP. THIS CHAMPIONSHIP IS OPEN ONLY TO INDIVIDUALS WHO HAVE CREATED A FREE ACCOUNT ON DUELS.COM AND WHO ARE, AS OF May 2, 2008 AND AT THE TIME OF ANY AWARD OF A PRIZE: (A) LEGAL RESIDENTS OF THE UNITED STATES, CANADA, AUSTRALIA, NEW ZEALAND, SINGAPORE, THAILAND, MALAYSIA, (B) THE AGE OF MAJORITY IN THEIR COUNTRY OF RESIDENCE, (C) HAVE AUTHORIZED ACCESS TO A DUELS ACCOUNT THAT IS IN GOOD STANDING UPON THE COMMENCEMENT DATE (DEFINED BELOW), AND WHICH REMAINS IN GOOD STANDING THROUGHOUT THE CHAMPIONSHIP (THE "ACCOUNT"); AND (D) WHO ARE NOT RESIDENTS OF THE US STATES OF ARIZONA, CONNECTICUT, NORTH DAKOTA, MARYLAND OR VERMONT OR THE PROVINCE OF QUEBEC, CANADA OR RESIDENTS OF THE AUSTRALIAN STATES OF VICTORIA, QUEENSLAND OR THE AUSTRALIAN CAPITAL TERRITORY (THE "ELIGIBLE PARTICIPANTS"). If you are under the legal age of majority in your country of residence, but over the age of 13 (a "Minor"), you may still enter and be one of the Eligible Participants if you otherwise meet all of the eligibility criteria set forth above and one of your parents or legal guardians read and agree to these Championship rules on your behalf in order to participate in the Championships, and be eligible to win a prize. Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate family and household members of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Void in the US states of Arizona, Connecticut, Maryland, North Dakota, or Vermont, the Canadian province of Quebec or the Australian states of Victoria, Queensland and the Australian Capital Territory, and where otherwise prohibited or restricted. Eligible Participants must have a Duels account which includes an associated valid email address. Sponsor reserves the right to verify the email address provided to Sponsor by the Eligible Participant. The Eligible Participant must be the authorized account holder of the Account. "Authorized account holder" is defined as the natural person who registered the Account on the Duels gaming service. There is a limit of one Avatar per Eligible Participant.
2. Disclaimer.
Sponsor will not be responsible for (a) any late, lost, misrouted, garbled or distorted, inaccurate, incomplete or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Championship disruptions, injuries, losses or damages caused by events beyond the control of Sponsor (although the Sponsor will take reasonable precautions to ensure reasonable safety); or (d) any printing or typographical errors in any materials associated with the Championship. Additionally, in accordance with the Duels Terms of Use and without limiting Sponsor's rights therein, Sponsor retains the right to modify or delete content, data, player characters, accounts, statistics, user profiles, weapons, armor, quests, loot, any other information created, accumulated, stored or uploaded to Duels at any time and for any reason at its sole discretion.
3. Championship Period.
The Championship shall commence on the start of the World Duels Championship Ladder, which shall be at approximately 10:00 AM Pacific Time (5:00 PM GMT) on May 2, 2008 (the "Commencement Date"), and shall continue through the end of the World Duels Championship Finals, which are expected to conclude on May 11, 2008.
4. Entry
To enter, simply go to www.duels.com, log in using your account name and password, click on the link for the Championship, and register for the World Duels Championship ladder.
5. Championship Rules.
All matches that take place in the Championship shall take place in accordance with the Duels Terms of Use which are available at http://www.duels.com/pages/termsofuse. In the event of any conflict between these Official Rules and the Duels Terms of Use, these Official Rules shall prevail. "Cheating," as determined in Sponsor's sole discretion, and specifically including, without limitation, "win-trading," shall result in disqualification of the participant.
In the event of any dispute over the outcome of a Duel, the outcome will be determined by the Sponsor, in its sole discretion. Any such decision will be final and have immediate effect.
6. Determination of Winners.
A. Qualification Ladder and Championships
1. The Qualification Ladder. The World Duels Championship Ladder shall last for one week, and will commence on May 2, 2008 at approximately 10:00 AM Pacific Time (5:00 PM GMT) (subject to 'Server Maintenance' to be performed by Sponsor), and end on May 9, 2008 at 10:00 AM Pacific Time (5:00 PM GMT). To qualify for the Semi-Final Tournament, each participant must accept a minimum of 50 challenges. At the end of the World Duels Championship Ladder, the 256 players who have the highest Ladder Rating will be placed into the WDC Semi-Final Tournament. In the event of a "tie" where more than one player is tied for the last positions eligible for a placement in the WDC Semi-Final Tournament, a single elimination "mini tournament" will be held between the players tied for those last positions, and the winner of the "mini tournament will be placed into the WDC Semi-Final Tournament. The date, time and brackets for such a "mini tournament" shall be determined by Sponsor, in its sole discretion.
2. The Semi-Final Tournament. The Semi-Final Tournament shall commence on May 10, 2008 at approximately 12:00 AM Pacific Standard Time ( 7:00 PM GMT) (subject to 'Server Maintenance' to be performed by Sponsor) and end the same day. The 256 highest ranked WDC Ladder participants shall be placed, based on rating, into 16 different 16 player Tournaments. After each completed Challenge, the winning player will receive 5 points, 2nd place 4 points, 3rd place, 3 points, 4th place 2 points, 5th place 1 point. This process will be repeated a total of five times. At the end of the Semi-Final Tournament, sixteen players who have the highest score will be placed into the WDC Finals, as described below. In the event of a "tie" where more than one player is tied for the last positions eligible for a placement in the WDC Finals, the winner will be determined based on ladder rating. If this does not resolve the matter, the tie will be broken based on the players' Ladder win percentage.
3. The WDC Finals. The WDC Finals shall commence on May 11, 2008 at approximately 12:00 AM Pacific Standard Time ( 7:00 PM GMT) (subject to 'Server Maintenance' to be performed by Sponsor) and end the same day. The 16 highest ranked WDC Semi-Final participants shall be placed by rank into one 16 player Tournament. After each completed Challenge, the winning player will receive 5 points, 2nd place 4 points, 3rd place, 3 points, 4th place 2 points, 5th place 1 point. This process will be repeated a total of five times. At the end of the WDC FInals, the 2 players who have the highest score will be placed into the WDC Championship, as described below. In the event of a "tie" where more than one player is tied for the last positions eligible for a placement in the WDC Championship, the winner will be determined based on ladder rating. If this does not resolve the matter, the tie will be broken based on the players' Ladder win percentage.
4. The WDC Championship. The WDC Championship shall commence on May 11, 2008 following the completion of the WDC Finals (subject to 'Server Maintenance' to be performed by Sponsor). The 2 highest ranked WDC Semi-Final participants shall participate in a total of 5 challenges. At the end of the WDC Championship, the player who has won the most challenges will be crowned the World Duels Champion.
7. Prizes.
1. World Duels Championship.
A. Participation in the WDC Ladder: All ladder participants will receive a special black World Duels Championship tee shirt for their in-game avatar
B. 129-256 Place Winners. The 256 Duelists to make it into Semi-Final Tournament will receive a special red World Duels Championship tee shirt for their in-game avatar.
C. 65th - 128th Place Winners: The final sixty three Duelists will receive two noblestones and a WDC Tournament Badge
D. 33rd - 64th Place Winners: The thirty third through sixty fourth placed Duelists will receive eight noblestones and a WDC Tournament Badge.
E. 17th - 32nd Place Winners: The seventeenth through thirty second placed Duelist will receive 20 noblestones and a WDC Tournament Badge.
F. 9th-16th Place Winners: The ninth through sixteenth placed Duelists will receive 50 Noblestones and a WDC Sweet Sixteen Badge.
G. 5th - 8th Place Winners: The fifth through eighth place Duelists will receive 75 Noblestones and a WDC Elite Eight Badge.
H. 3rd & 4th Place Winners: The third and fourth place Duelists will receive $250, 100 Noblestones and a WDC Final Four Cup Badge.
I. 2nd Place Winner: The second place winner shall receives $500 USD, as well as the opportunity to create a unique artifact (Red) item and a WDC Finalist's Cup Badge.
J. 1st Place Winner: The World Duels Champion receives $1000 USD, the opportunity to create a unique artifact (Red) item and a WDC Victor's Cup Badge.
2. Prize Restrictions. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. If any prize or prize notification is returned as undeliverable, or potential winner does not respond within seven (7) days of notification, or refuses to execute an applicable document, prize will be forfeited and awarded to an alternate winner. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). FEDERAL, STATE, AND LOCAL TAXES, INCLUDING, WITHOUT LIMITATION, AS APPLICABLE, VAT TAXES AND CUSTOMS TAXES, WHICH ARE ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
*All cash prizes will be paid in U.S. currency and will be delivered to the winners via Paypal to the e-mail address provided by the Eligible Participants as part of the registration process. Winners may be required to complete and submit to Sponsor an IRS form W-8 or W-9 to receive a cash prize. Winners not eligible to receive cash prizes will be rewarded with a comparable amount of Noblestones.
Collection of Information.
The information necessary to operate the Championship was collected by Sponsor at the time that each Eligible Entrant registered the Duels account used to participate in the Championship, and without limiting Sponsor's rights under its privacy policies with regards to its use of the information, will be used to contact you specifically for operation of the Championship. Information collected in connection with the Championship will otherwise be collected in accordance with Sponsor's privacy policy, available at http://www.duels.com/pages/privacypolicy . By agreeing to these Official Rules, you are also agreeing to the terms of Sponsor's privacy policy. You are informed that the data collector is Challenge Online Games, Inc., and the data utilized for the Championship was collected from all Eligible Participants at the time that the Eligible Participant registered the Duels Account which the Eligible Participant utilizes to compete in the Championship. Upon request, you will be provided with access to your personal data. You also have a right of opposition to the data collection, under certain circumstances. To exercise such right, you may write to "Challenge Online Games -Personal Data," c/o Challenge Online Games, Inc., 816 Congress Avenue, Suite 1470, Austin, TX 78701. You may also withdraw your personal data upon request, however you will be disqualified as a entrant in the Contest if you withdraw your personal data prior to the determination and fulfillment of the prizes listed in Section 7 herein. Additionally, such a request may place you in non-compliance with the Duels Terms of Use.
General Release.
By entering the Championship, you release Sponsor and any of its parent companies, subsidiaries, affiliates, directors, officers, employees, representatives, agents and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Championship (including, without limitation, participation in the Championship) or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Some jurisdictions do not allow the exclusion of implied warranties on applicable statutory rights; and in the case of the countries of the United Kingdom and Spain, (ii) limitations on a contracting party's liability with regards to damages or death caused due to its negligence or intentional misconduct, so the above exclusions and limitations may not apply in some cases.
Affidavit & Release.
As a condition of being awarded any prize, winners may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability. In the event that a winner is under the age of majority in his or her country of residence, winner's parent or legal guardian will be required to execute and deliver such documents. Failure to return a signed affidavit within seven (7) days may result in forfeiture of prize. Potential winners are responsible for ensuring return of all required materials; proof of sending will not be considered proof of receipt by Sponsor.
Winners List; Rules Request.
A list of winners will be posted at http://www.duels.com/wdc/details no later than May 12, 2008. For a copy of the winners list, send a stamped, self-addressed, #10 business-size envelope (4 1/8" x 9 1/2") after May 15, 2008 and before June 30, 2008 to Sponsor at the address listed below, Attn: World Duels Championship - Winners List. To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed below, Attn: World Duels Championship - Rules Request. Canadian residents may omit return postage.

Miscellaneous.
Sponsor reserves the right to patch or update Duels at any time to fix bugs, change balance, or add features as deemed appropriate by the Sponsor, in its sole discretion, without suspending or canceling the Championship. The Championship and these Official Rules will be governed, construed and interpreted under the laws of the state of Texas in the United States. Eligible Participants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel or modify the Championship or any Eligible Participant's participation in the Championship should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Championship, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Championship as planned. Due to server capacity and other technical limitations beyond the control of Sponsor, Sponsor reserves the right to limit the number of Eligible Participants. Eligible Participants who violate these Official Rules, tamper with the operation of the Championship or engage in any conduct that is detrimental or unfair to Sponsor, the Championship or any other Eligible Participant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Championship. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Championship. License Agreement.
Eligible Entrants are at all times subject to the terms of Sponsor's Terms of Use available at http://www.duels.com/pages/termsofuse. Should any Eligible Entrant be found in violation of such Terms of Use, such Eligible Entrant will not be eligible and will be automatically disqualified from the competition and Sponsor reserves all rights to claim any equitable or legal remedies for loss, and remedies under breach of contract, due to the violation of the Terms of Use.
